Criminal Law

    If you (or a loved one) have been accused of committing a crime, you need information and assistance: information about the criminal justice system and assistance with an unfamiliar, stressful, and usually frightening situation.  If you are not a U.S. citizen, you have another essential need - to determine whether there are deportation consequences if you are convicted of the crime you have been accused of committing.

    Whether you are a U.S. citizen or an alien, you should not try to represent yourself and/or accept the "good deal" (plea bargain) the prosecutor is offering before obtaining legal advise.  The consequences could be devastating and irreparable.     Criminal Defense Attorneys:  Are you aware that your non-citizen client may be deported if convicted of not only most felonies, but of certain misdemeanors as well?  To which felonies can your alien client safely plea?  Which misdemeanors are never safe pleas?  Is DAJ considered to be a "conviction" for immigration purposes?  Pretrial Diversion? 

    Family Attorneys: Your divorce client is a "conditional" resident and the spouse is a U.S. citizen.  Are there immigration issues that should be discussed with your alien client?  If the situation is reversed and you represent the citizen spouse, is it important for you to understand the alien spouse's immigration status?  Your client says to you, "She only married me to get her green card and I want to get her deported."  How do you respond?

    If you are a family or criminal attorney, it is a certainty that during your law career, either your client or a party to the suit will be a non-citizen.  When that happens, if you do not know the answers to these questions, to protect your client and yourself, you should consult with an immigration attorney.

      I am Janice P.                        Immigration Law                       
    Unfortunately, many people believe that the "practice" of immigration law is simply filling out forms.  Nothing could be further from the truth.  In American Jurisprudence, this body of law is one of the most complicated and difficult areas to comprehend.  The code has been described as a "complex and byzantine web" with laws "that are confusing and contradictory."  It  therefore should not be a surprise to learn that deciphering this tangle of rules and regulations 
can leave even members of the legal profession - attorneys - feeling baffled and frustrated.  

    Compounding this problem, immigration law can be harsh and very unforgiving when those that are inexperienced in navigating this "maze" make an unintentional error.  An innocent mistake or omission can have detrimental consequences.  To illustrate just how serious this can be, imagine that an application is sent for filing and by mistake, a required document or supporting evidence was not included.  When the omission is discovered, filing of the case may be refused and the entire package returned to the applicant.  Under those circumstances, correcting the error and then refiling will be necessary, provided a 2nd chance to resubmit the application is allowed.  In some situations, refiling may not be permitted and the end result is that the previous immigration opportunity is lost, due to a simple documentary omission.

Collaborative Law: I am an advocate of Collaborative Family Law because it is an extraordinarily different approach to resolving conflicts in family cases through a procedure that is both analytical and civilized.  Unlike the adversarial approach to domestic issues which can be extremely destructive, foster hostility, and is drenched with negativity, the collaborative law method is highly constructive and facilitates cooperation, which leads to creative, fair solutions that ultimately result in a far more positive outcome for all parties.  Divorce, child visitation, custody, support, modification of existing orders, and paternity are family law based legal matters where the collaborative method, rather than the usual adversarial process, may be an appropriate alternative for the parties to consider.

Litigation: If the circumstances of your case are such that the collaborative route is not an option, the following is a brief summary of how I approach non-collaborative family cases.

   Since the majority of family cases are not and should not be treated as a "Declaration of War" between the parties, I first utilize every resource available to settle the issues - resources that do not require "combat" in open court.  My primary goals will be to achieve the best possible outcome for you and to reach an out-of-court agreement that will end the conflict.  If, after exhausting those remedies, it is apparent that litigation is the sole avenue remaining to resolve the case, then and only then, will I resort to a costly "battle" in the courtroom.
